My Insurer Denied My Right to Appraisal, and No One Could Enforce It

During the handling of my truck claim with Allstate, I attempted to invoke my Right to Appraisal provision as outlined in my policy. However, I was refused the opportunity to proceed with appraisal.

As a policyholder, I believed this provision existed specifically to protectconsumers in situations where there is a dispute over the value or cost of repairs. Being denied access to this contractual right left me without a meaningful avenue to resolve the disagreement.

I also reached out to the Commissioner’s Office for assistance, hoping that the policy provisions and applicable insurance codes would be enforced. Unfortunately, I was informed that there was no mechanism to require the insurer to comply. As a result, I was left personally responsible for costs that I believe should have been addressed through the appraisal process.

This experience placed a significant financial burden on me and highlighted what I see as a gap in consumer protection. When policy language provides a Right to Appraisal, policyholders should be able to rely on that right being honored and enforceable. Without clear enforcement authority, the provision offers little practical protection
